Terms of Service for VegasGeek

1. Acceptance of Terms

By accessing vegasgeek.com or purchasing any services (the “Services”), you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or services.

2. Description of Services

VegasGeek offers WordPress maintenance, web design, and technical consulting services.

  • Maintenance Plans: Our monthly care plans include WordPress core updates, plugin/theme updates, nightly off-site backups, and security monitoring.
  • One-Off Updates: Individual site tweaks or refreshes are billed as separate projects.

3. Subscription & Payment Terms

  • Billing: Maintenance plans are billed at our standard rate when paid monthly. Annual plans are also available and may include a discounted rate.
  • Automatic Renewal: Subscriptions renew each month automatically. You may cancel at any time, but no refunds will be issued for partial months already billed.
  • Late Payments: We reserve the right to suspend maintenance services (including backups and security monitoring) if payment is not received within [5] days of the due date.

4. Client Responsibilities

To provide effective maintenance, you agree to:

  • Provide administrative access to your WordPress dashboard and, if necessary, your hosting provider.
  • Notify us before making significant changes to the site code or installing new, untested plugins that may conflict with our maintenance protocols.
  • Maintain ownership and responsibility for the content you upload to your site.

5. Scope & Exclusions

Our maintenance plans are designed to keep your site running smoothly. The following are generally excluded unless specifically agreed upon in writing:

  • Full website redesigns or new feature development.
  • Fixing “user-error” issues caused by the client or third parties.
  • Cost of premium third-party plugin licenses (unless otherwise stated).
  • Content creation or copywriting.

6. Limitation of Liability

While we use industry-standard tools (Security Monitoring, Backups) to protect your site, VegasGeek cannot guarantee that a site will never be hacked or experience downtime.

  • In the event of a security breach or data loss, our liability is limited to attempting a restoration from our most recent backup.
  • We are not liable for any lost profits, data loss, or business interruptions resulting from site downtime or third-party hosting failures.

7. Intellectual Property

  • Our Content: All logos, text, and designs on VegasGeek.com are owned by VegasGeek.
  • Your Content: You retain all rights to the content, trademarks, and data on your own website.

8. Affiliate Disclosure

As noted in our Privacy Policy, we may use affiliate links. We only recommend products we trust, but we are not responsible for the performance or policies of third-party vendors.

9. Termination

Either party may terminate the maintenance agreement at any time. Upon termination:

  • VegasGeek will cease all updates and monitoring.
  • The client is responsible for ensuring they have their own backup and security measures in place moving forward.

10. Governing Law

These terms are governed by the laws of the State of Nevada. Any disputes shall be resolved in the courts of Clark County, Nevada.
